BANKING AND CAPITAL MARKETS


We represent banks and other financial institutions on a regular basis in commercial litigation, especially in the fields of banking law, insolvency law and corporate law.

We have many years of experience in dealing with litigation involving issues of the law on granting loans and collateral for loans, especially in the case of disputes about the validity of loan agreements and their termination as well as the enforcement of security interests, especially in the case of insolvency and in the defense of claims alleging preferential treatment in insolvency, and on the aspects of the law which require that financing be treated in the same manner as equity capital.

We have advised many of our credit institution clients over the course of many years in series litigation about issues of liability in connection with the distribution of capital investments (shares in investment funds, real estate, securities) and the financing of these capital investments and related issues involving the processing of payments.
