LABOUR LAW


Employees and working conditions are major factors for the success of a company. In order to ensure this success, there is an ongoing need to make adjustments when balancing the economic and personnel policy wishes of our clients with the requirements of labour law. We advise our clients about these intricate issues and, together with them, develop appropriate, practical solutions based on legal analysis and our experience. Of course, we also represent our clients in proceedings before the courts and administrative authorities, and we provide support in negotiations with works councils and unions.

Our fields of activity involve especially:
  • advising on complex restructurings,
  • co-determination rights of works councils as well as rights and duties of members in works councils,
  • establishing and advising on the legal position of European works councils, 
  • collective bargaining law, including the conduct of negotiations on collective bargaining agreements concluded with individual companies, 
  • structuring contracts for members of corporate bodies and senior management, 
  • terminating contracts,
  • designing regulations on working hours,
  • structuring bonus plans,
  • protection of business know-how, prohibitions on competition, 
  • transfers of businesses, 
  • employee retirement plans,
  • protection of employees' personal data.

In addition, we advise on transformations of corporate form and the employment law aspects in M&A transactions. We conduct employment law due diligence, negotiate the regulations in purchase agreements involving labour law and deal with the associated measures under employment law, e.g. concluding a settlement of interests, designing new service contracts for management and retention programs.

We provide our clients with client information letters on selected court decisions or new employment law legislation.
